1. Acceptance of Terms

These Terms and Conditions ("Terms") are a legally binding agreement between Misbahu Tijjani Muhammad (hereinafter referred to as "MESVARH," "I," "my," or "me"), an individual developer operating from Kano, Nigeria, and you ("User" or "you") regarding your use of all mobile applications published under the MESVARH developer account.

By downloading, installing, or using any of my Apps, you agree to be bound by these Terms. If you do not agree, do not download or use the Apps.

These Terms apply to the following application groups and their individual titles:

• Group A (Islamic Apps): Taskar Tarihi Annabawa, Taskar Tarihi Watanni, Taskar Tarihi Ramadan, Mu'ujizar Al-kurani 1 & 2, and Dr Nasir Kankarofi.
• Group B (Hausa Books): Magana Jarice, Ruwan Bagaja, Ilya ɗan Maikarfi, Jiki Magayi, Suda, Mazan Jiya, Kundin Tsatsuba, Matsatsubi, and Malukussaifi 1, 2, 3 & 4.
• Group C (Games): Kacici kacici.

2. Eligibility

My Apps are intended for users aged 13 years and above. By using the Apps, you represent and warrant that you are at least 13 years old. If you are under 18, you confirm that you have obtained parental or guardian consent to use these Apps under these Terms.

3. Intellectual Property Rights

All content, code, graphics, text, app names, game mechanics, and design elements within the MESVARH Apps are the exclusive intellectual property of MESVARH (Misbahu Tijjani Muhammad), unless otherwise stated.

You are granted a limited, non-exclusive, non-transferable, and revocable license to use the Apps for personal, non-commercial purposes only. You may not:

• Copy, modify, distribute, or reverse-engineer any part of the Apps.
• Use the Apps for any unlawful purpose.
• Remove or alter any proprietary notices or copyright marks.

4. User Conduct & Prohibited Activities

You agree to use the Apps responsibly. Specifically, you shall not:

• Use any of my Apps (particularly Group C games) to cheat, hack, or exploit bugs to gain unfair advantages in leaderboards or achievements provided by Google Play Games.
• Harass, abuse, or defame other users through any in-app features.
• Upload or transmit any malware, viruses, or harmful code.
• Use the Apps to distribute unsolicited promotional content (spam).

Violation of this section may result in immediate termination of your access to the App without notice.

5. Google Play Games (Group C Only)

The game Kacici kacici integrates with the Google Play Games service. By using this feature, you agree to Google's separate Terms of Service. I am not responsible for:

• Suspension or termination of your Google Play Games account by Google.
• Loss of game progress, achievements, or leaderboard scores due to server outages, your own device issues, or account changes.

6. Third-Party Advertising (Groups B & C Only)

Groups B (Hausa Books) and C (Games) integrate the Unity Ads SDK to display advertisements. Please note:

• Advertisements are served by Unity Technologies, an independent third party.
• I do not control the content, accuracy, or appropriateness of any advertisements displayed.
• Interacting with an advertisement (e.g., clicking it) will direct you to third-party websites or services governed by their own terms and policies. MESVARH assumes no responsibility for such external content.

7. In-App Purchases & Refunds

Currently, all MESVARH Apps are free to download and use. If I introduce premium features or in-app purchases in the future:

• All purchases are final and subject to Google Play's refund policy.
• I reserve the right to modify pricing or discontinue premium features with reasonable notice.
• Virtual items (e.g., coins, extra lives) have no real-world monetary value and cannot be exchanged for cash.

8. Disclaimer of Warranties

The MESVARH Apps are provided on an "AS IS" and "AS AVAILABLE" basis. I make no warranties, expressed or implied, regarding:

• The App's functionality, accuracy, or reliability.
• Uninterrupted or error-free operation (e.g., server downtimes, bugs, or crashes).
• The suitability of Islamic content (Group A) or Hausa literature (Group B) for your personal needs.

You use the Apps at your sole risk.

9. Limitation of Liability

To the fullest extent permitted by applicable law, MESVARH (Misbahu Tijjani Muhammad) shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages.
• Loss of data, profits, or goodwill.
• Damages arising from third-party services (e.g., Unity Ads, Firebase, Google Play Games).

My total aggregate liability to you shall not exceed $10 (USD) or the equivalent in Nigerian Naira. This limitation applies regardless of the legal theory (contract, tort, or otherwise).

10. Governing Law & Dispute Resolution

These Terms and any disputes arising from your use of the Apps shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law principles.

• Informal Resolution: Before initiating any legal proceedings, you agree to contact me at mesvarh@hotmail.com to attempt an amicable resolution for at least 30 days.
• Jurisdiction: If a formal dispute cannot be resolved amicably, the exclusive venue for any litigation shall be the courts of Kano State, Nigeria.

11. Termination

I reserve the right to suspend or terminate your access to any or all of my Apps at any time, with or without notice, if you violate these Terms. Upon termination, you must cease all use of the affected App and delete it from your device. Provisions concerning Intellectual Property, Limitation of Liability, and Governing Law shall survive termination.

12. Changes to These Terms

I may update these Terms from time to time. Material changes will be notified via an in-app notice or an updated Play Store listing. The "Last Updated" date at the top reflects the most recent revision. Your continued use of the Apps after any changes constitutes your acceptance of the new Terms.

13. Entire Agreement

These Terms, together with my Privacy Policy (available via the Google Play Store listing), constitute the entire agreement between you and MESVARH regarding your use of my Apps and supersede any prior agreements.
